NOTICE OF PUBLIC SALE OF ASSETS in Waukesha, Waukesha County, Wisconsin

NOTICE IS HEREBY GIVEN that at or after 10 a.m. prevailing Central time on May 10, 2021, BYLINE BANK f/k/a RIDGESTONE BANK ("Lender") as secured creditor, will offer to sell, or cause to be sold, at a public sale conducted in accordance with the Order for Judgment of Replevin in Lincoln County Case Number 2019CV000132 and the Uniform Commercial Code as enacted in the applicable jurisdiction and other applicable law (the "Public Sale"), at the offices of Cramer, Multhauf & Hammes, LLP, 1601 East Racine Avenue, Suite 200, Waukesha, Wisconsin 53186, all of the right, title and interest of SNOWTRACKS COMMERCIAL WINTER MANAGEMENT, LLC and MICHAEL BRONSTEATTER in, under and to the assets listed on Exhibit A and Exhibit B (“Assets”).

The Assets will be offered and sold, as is, where is, at the Public Sale. Any buyer wishing to make an offer for the Assets at the Public Sale may do so. Bids may be submitted for any or all of the Assets or for one or more individual lots. All offers must be for cash, contain no contingencies that are unsatisfactory to Lender and, unless otherwise agreed by Lender, have a closing date of no later than one day after the conclusion of the Public Sale. Lender reserves the right to sell all of the Assets to one buyer or to multiple buyers in individual lots. As a result of the ongoing COVID-19 pandemic, Lender will accept written bids submitted prior to the date of the Public Sale.

If one or more offers for any or all or part of the Assets satisfactory to Lender is received at the Public Sale, Lender will accept such cash offer for such Assets. If no offer satisfactory to Lender is received, Lender expressly reserves the right to withdraw all or part of the Assets from the Public Sale. Lender may cancel the Public Sale at any time, or cause the Public Sale to be adjourned from time to time, without further notice other than by announcement at the time and place for the Public Sale described above.
